ACCEPTANCE

Welcome to Pump Paddle Boards LLC DBA Galapagos Pronto (hereby refered to as "Galapagos Pronto"). These Terms and Conditions ("Terms") govern your use of our website and the booking of Galapagos cruises, tours, and land-based tours. By using our website and booking our services, you agree to comply with and be bound by these Terms. Please read and understand these Terms before signing at the bottom. 

The contract

All persons wishing to make a booking must sign this Booking Terms and Conditions form. All such persons (hereafter called the client) will be bound by the conditions, which follow. If a signed Booking Terms and Conditions form is not received, payment of the deposit represents acceptance of the following conditions.

Payment

The booking form must be completed and signed by all clients wishing to travel. All forms should then be sent to Galapagos Pronto with a deposit stipulated on the invoice. Acceptance of the client's reservation must be confirmed in writing, which is when a contract comes into existence. Balance of the tour is due for payment 60 days prior to the departure date. Any bank charges are the responsibility of the client. Please check with your bank for transfer fees. Payment by credit card may incur extra charges. Paying via international money transfer is the most cost-effective form of payment.

Cancellation by the client

Any cancellation by a client must be made in writing. The date on which the email is received by Galapagos Pronto will determine the cancellation charges applicable. The cancellation charges below are a percentage of the total tour price, excluding insurance. You are strongly advised to take out cancellation insurance at the time of reservation.

A. Cancellation 61 days or more before departure date: Transferrable Deposit B. Cancellation 60-31 days before departure date: Loss of 50% of total tour price C. Cancellation 30 days or less before departure date: Loss of 100% of total tour price

Unused services

There will be no refunds for unused services.

Cancellation of the tours by Galapagos Pronto

Galapagos Pronto reserves the right to cancel a tour for any reason, but will not cancel a tour less than 8 weeks before departure except for unusual or unforeseen circumstances outside Galapagos Pronto’s control. When a tour is canceled, the client may choose between a refund of all monies paid or any alternative tour offered in lieu by Galapagos Pronto.

Flexibility

The client appreciates and acknowledges that the nature of this type of travel requires considerable flexibility and should allow for alternatives. It is understood that the route, schedules, itineraries, amenities, and mode of transport may be subject to alteration without prior notice due to local circumstances or events, which may include sickness or mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, climate, and other unpredictable or unforeseeable circumstances.

Changes

Galapagos Pronto reserves the right to change any of the facilities, services, or prices described before a reservation is made. If such a change is made, the client will be informed at the time of reservation. The client is able to make a change to a confirmed booking arrangement only if more than 60 days before departure. Extra costs incurred will be charged.:

If prevented from traveling

Cancellation charges listed above are applicable regardless of the circumstance. You are strongly advised to take out cancellation insurance at the time of reservation that covers unforeseen circumstances.

Acceptance of risk

The client acknowledges that the nature of the tour is adventurous and that such holidays may involve a significant amount of personal risk.

Client's responsibility

It is the client's responsibility to let us know before booking whether they have any special requirements, limited mobility, or medical conditions that might affect their ability to take part in our tours. A reasonable level of fitness is required and if in doubt of the suitability of our tours, please just ask us. If there are any medical concerns, it is the client's responsibility to seek confirmation from their doctor prior to booking the trip. You may be asked to complete a medical form or produce a doctor's certificate prior to travel.

Itineraries

All itineraries are a guide only and are subject to alteration on the occurrence of any unpredictable conditions and circumstances, which may arise in this delightfully chaotic continent. Any changes do not have to be notified until the trip briefing before the tour.

Authority on tour

At all times the decision of Galapagos Pronto’s Tour Leader will be final on all matters likely to endanger the safety and well-being of the tour. Should the client fail to comply with the laws, customs, foreign exchange, and drug regulations of all countries visited, the Tour Leader may order the client to leave the tour without any refund.

Travel documents

The client must be in possession of a valid passport and all visas, permits, and certificates including vaccination certificates. It is ultimately the responsibility of the client to ensure they have the necessary documentation.

Factors outside of Galapagos Pronto's control

Galapagos Pronto cannot accept any liability for matters outside its control such as political disputes, border closures, refusal of visas, industrial action, delayed flights, and unforeseeable climate conditions which may prevent the itinerary from being followed.

Insurance

The client is willing to accept full responsibility for insurance which must cover personal accident, medical expenses, loss of effects, repatriation costs, and all other expenses which might arise as a result of loss, damage, injury, delay, or inconvenience occurring to the client. It is compulsory that all clients have personal travel insurance. 

Local conditions

Due to political and cultural differences, as well as generally tougher physical conditions, travel to the areas we visit involves risks other than those we take in our daily lives. It is important clients make themselves aware of the risks involved. Travel in Third World countries is different from travel at home.

Responsibility

All services herein are organized by Galapagos Pronto and their partners. Notice is hereby given that all arrangements made on behalf of customers are made by organizers on the sole condition that the organizers shall not be held responsible for any injury, death, accident, delay, loss, damage, or irregularity. Galapagos Pronto acts as an agent for transport companies, hotels, and other contractors and shall not be held liable for any injury, damage, loss, delay, or irregularity that may occur.

Claims and complaints

If a client has a complaint against Galapagos Pronto, they must first inform their Tour Leader whilst on the tour so that they can attempt to rectify the matter. Any further complaint must be put in writing to Galapagos Pronto within 30 days of the end of the tour.

Airlines

The contents of this document do not commit the airlines mentioned therein, or any airline whose services are used in the course of any tour. The responsibility of the airlines is limited to the carriage of passengers and baggage in accordance with their conditions of carriage. The client cannot cancel the contract without penalty in the event of a change of aircraft operator, aircraft type, or destination.

Prices and surcharges

Galapagos Pronto reserves the right to impose surcharges (or price decreases) up to 8 weeks before departure due to unfavorable changes in exchange rates, increases in airfares or other transport costs, taxes, or if government action should require us to do so.

Prices

All prices shown are subject to currency fluctuations and airline increases. Please check when booking for current prices. All prices in USD.

Marketing acceptance

The client agrees to allow Galapagos Pronto to use any photos or videos taken of them while on tour. Galapagos Pronto may use this content for promotional and marketing purposes. The client agrees this content may be used in any medium Galapagos Pronto chooses (both online and in print) and grants Galapagos Pronto an unconditional royalty-free, worldwide license for use of this content.

Privacy policy

Any information collected about the client may be used by Galapagos Pronto to effectively operate the tour or communicate special offers and marketing efforts directly with the client. Such information may also be disclosed to service providers, as well as agents and partners involved in operating the tour. The complete Galapagos Pronto privacy policy is available on the Galapagos Pronto website for the client to review.

 
Passenger Acceptance

As the name above and on behalf of all travel companions listed above, I have read the attached terms and conditions and accept and understand that they form part of this contract. I undertake on my own behalf and on behalf on any other persons for whom this is a joint booking to accept the terms and conditions of the individual operator as stated below and the decisions of the trip leaders they appoint. I also understand that I am booking on an adventure holiday and standards such as accommodations, transport, medical service and other factors will not be of the same standard that I/we are not used to at home, or that might be found on a conventional holiday.
